Hey anyone who uses #etsy, they are changing their terms and conditions so you cannot participate in class action lawsuits against them. You can opt out using these steps, but you have to do it before 23rd August 2023.

It applies if you have a profile there, whether you sell or not!

Below are step-by-step instructions on how to opt out by Wednesday, August 23, 2023. This will take < 10 minutes to do.
Sign in to Etsy and go to this link: https://www.etsy.com/your/account 
Scroll down and note your email address associated that's with your account under "Current email"
Next, scroll to the top of the page. In the top right corner, click the "Your account" icon (to the left of the shopping cart)
In the drop down menu, click "View your profile"
Look at the URL of this page, and note your username. It should be found in etsy.com/people/[your username] (it may also be like etsy.com/people/[your username]?ref=xyz)
If you sell stuff on Etsy, note the name of your shop. If you don’t sell anything on Etsy, continue to the next step.
Draft an email to arbitrationoptout@etsy.com with the subject line Opt out request
Copy the template message below, replacing the fake info I've used here as an example, and send the email:
Please consider this email my valid request to opt out of arbitration as described in Section 11 of the Terms of Use.
Name: John Smith
Account email address: johnsmith@myemail.com
Username: johnsmith
Shop name: Appleseed Designs (or N/A if you don't sell on Etsy)

@stavvers Well, good luck to them trying to protect themselves from litigation! They have gone completely off the rails, such terms cannot be enforced legally in any court of law. Very sad, I have a few artist friends who had their shops on Etsy, so they are in a really bad situation at the moment.

@dotslash @stavvers unfortunately, in the United States, that is not the case. The Supreme Court has ruled multiple times in the last decade plus that consumers can be forced into binding arbitration. It’s one of the biggest reasons the balance of power has shifted from people to corporations here.

@stavvers It looks like this is just for users in North and South America? The equivalent for UK/European users is section 12 (tl;dr Irish law applies) and I don't think they can legally block arbritration here.

@RealGene @stavvers So you have to find enough users willing to potentially lose money, so that the legal fees for Etsy are big enough to go for a settlement instead. This all is a very strange legal practice from European perspective.

@stavvers Of note, the URL you mention is _not_ available if you use the Etsy app (at least on the iPad) - so you have to log in to the web page via a browser instead.

@stavvers Sorry, but due to security, I would never ever write a mail with my private data to any mailadress posted in social media by an anonymous! How can I be sure that this is no phishing mail adress?
If there would be something like an opt-out, it had to be an official link on etsy, at least on my profile.
I find neither a changement of conditions nor did I get a mail by Etsy about it.
How do we know that this is no scam or phishing action? Do you have any link with a legal source? 1/2

@NatureMC “arbitrationoptout@etsy.com”. This cannot be a phishing attempt as the email would go straight to Etsy’s SMTP server.

Phishing attempts usually rely on you misreading (or not checking) a clickable link, if you type `etsy.com` you go to `etsy.com`, interceptions are possible but then phishing is the least of your worries.

@NatureMC @stavvers Looks like Section 12 of this page would define dispute resolution for Europe/rest of world: etsy.com/legal/terms-of-use and also details opt out for North & South America in section 11. (sorry if a duplicate post)

I do like this sentence. Not: "If you’re upset with us, let us know."
I'm happy that I closed my Etsy shop. Unfortunately they don't let you close the site for it, so I regularly have to check back.

etsy.com/uk/legal/terms-of-use. a simple search for" Etsy Arbitration" took me to Etsy's site and their TOS ...the deal is a July 24th change in TOS that gives people 30 days to opt out of accepting the new TOS. in N and S AMERICA, so if you're not in those areas…ignore.

@stavvers @garius Considering your usual boosts of small creators, who may well use Etsy, you might like to publicise this? I can't think banning users from class-action lawsuits can signal anything but a giant skeleton in the closet somewhere.
