@failedLyndonLaRouchite @ThatOneGuyT_T The Constitution specifically says the right of trial by jury exists for civil money disputes above a certain amount. This should be unconstitutional. @sunguramy @ThatOneGuyT_T wow! I heard only brief details about this before! But I'm always in favor of trashing Disney, they're terrible 😝 @Jennifer @ThatOneGuyT_T oh the disney+ thing is a wtf, agreed! but the rest is like....woahhhhhh xD @sunguramy @ThatOneGuyT_T yeah Brian and Steve had better go for more than $50k if a giant corporation kills us 😂 @sunguramy @ThatOneGuyT_T @Jennifer It may be that they're leaving the door open to the jury to return big on punitive damages. Or maybe he doesn't want any blood money and just wants a court to find Disney guilty and to cover the costs of a nice tombstone for his wife's grave. @cczona @sunguramy @ThatOneGuyT_T @Jennifer Yes, I don't believe a dollar amount has been set by their pleadings. Just for procedural reasons they have to state they're seeking "at least $50,000". @Karstan @cczona @sunguramy @ThatOneGuyT_T @Jennifer @sunguramy @ThatOneGuyT_T @Jennifer It's not that he only thinks his wife's death is worth $50k compensation. It's that his lawyers had to ask for a minimum of $50k compensation in order to get the case heard by the court they wanted to hear it. The $50k language in the lawsuit is standard legal language. They'll ask for an order of magnitude or two more if it goes to trial. @ThatOneGuyT_T it doesn’t mean that and i wouldn’t be surprised if the lawyer/s arguing that is on their way to burgerflipping jobs now @ThatOneGuyT_T if disney seriously thinks there isnt going to be a significant spike in piracy rates then they are really out of touch with reality @ThatOneGuyT_T on the other hand, if you trick your wife into clicking through an agreement..... perfect crime. @ThatOneGuyT_T Many (including me) argue that individual (not commercial/organised) piracy can be justified as a form of civil disobedience against corporate greed, exploitation, and control. Given how the entertainment industry has tried to control the flow of information, the design of hardware, stymie internet development, and repeatedly exploited customers, it’s totally understandable. @ThatOneGuyT_T Another good reason for piracy as you call it is that they make the license 70+ years after author's death.... like give me a break. They don't even need 30 years period for a copyright license. The level of corruption is a sickening thing. Eff big business @ThatOneGuyT_T infact, Disney may actually be a case of it being morally WRONG to use their service @GGMcBG @ThatOneGuyT_T Only if you conflate legal and moral. Indeed, this is one set of circumstances that throws the difference between the two into stark relief. @ThatOneGuyT_T Dude is only seeking 50k in damages for the death of his wife, from a billionaire monopoly... Every part of this is upsetting. @ThatOneGuyT_T We hate both that we didn't for even a second think this was satire, and that we were absolutely correct. This is the bad place and we want out. @ThatOneGuyT_T I like how there's a bunch of replies and NOT ONE person is questioning why Disney is even being sued. They did not operate the restaurant in question, and much less "killed his wife". For sure, that Disney+ argument is extremely bizarre and should've never been put to paper because it has horrifying implications, but the whole case is odd. @ThatOneGuyT_T I don't really see Disney walking this one back. They allowed an attorney representing them to file this argument in a court of law. Even if they win, they lose. This will only empower others to include unconscionable terms of service in their agreements which will certainly cause fits for the courts. @ThatOneGuyT_T I'm so glad these #ToS are so illegal in #Germany... But yeah, #piracy is an act of #SelfDefense and #MutualDefense at this point! @kkarhan @ThatOneGuyT_T but I wonder if you can really sue a company owing a restautant for alleged criminal negligence of its employee in Germany. I would rather expect a criminal investigation against the chef and maybe his manager, maybe with civil lawsuits against them as well. |

aside from the slight inaccuracy* I have't seen one post about the merits of forced arbitration
far as I can tell, arbitration is bad for plaintiffs and *really bad for lawyers
