@JLab8 @mmasnick @caseynewton @zoeschiffer That's an interesting argument but I'd argue no. It'd be within the Citizens United hole, right? If the in-kind contribution is just speech, then it's protected by the First Amendment. Put another way, if selective promotion of certain accounts is an in-kind contribution, then Fox News should have been in trouble for this years ago. And maybe they should be but no one's successfully prosecuted that though.
