The French government has banned TikTok in New Caledonia following pro-independence protests.

When asked about the legality of the measure, it basically replied that since the territory is not subject to the EU’s jurisdiction, it’s perfectly allowed to ban social platforms however it likes.

What in the colonial crap is this bullshit. For fuck’s sake.

The government is exploiting a provision in the state of emergency law, which states: “The Minister of the Interior may take any measures necessary to ensure the interruption of any online public communication service that incites to commit acts of terrorism or glorifies such acts.”

They’re calling the protesters terrorists.

@rticks @nileane that's not entirely true when it comes to European territories, as they often specifically don't fall under EU jurisdiction (that's why EU citizens can't just move to these territories under the free movement law). That being said, it's obviously scummy and used as an excuse.

New Caledonia is a territory sui generis, meaning it is doing its own thing but doesn’t have the label “its own country” to the eyes of the EU.

New Caledonia has its own parliament and uses the polinesian franc, not the Euro.

“The overseas countries and territories (OCT) are dependent territories that have a special relationship with one of the member states of the EU. Their status is described in the Treaty on the Functioning of the European Union, and they are not part of the EU”

The 2016 US election and Brexit should have vaccinated us against online platforms, but unfortunately, it seems that it didn't.

US congress banned tiktok, is has 1 year to comply, about 11 months left.

The EU complained about Twitter already.

Please read about Brandolini's law and see that absolute freedom of speech is not always good.

@nileane I was thinking when I read the news earlier that this is the kind of censorship and comms blackout that (rightly) generates international outcry when it happens in Turkiye or Rwanda, and I will be watching with great interest to see what international opinion says when France does it to a blatant colonial asset.

@HauntedOwlbear @nileane FWIW, French governments have been traditionally quick on the draw and quite robust when it comes to internet censorship, be it at home, overseas or even leveraging the European council, always keen to test the limit of what is legally possible.
